Limitation period
You did not pay your contributions
The social insurance fund has 5 years to claim your contributions, counting as of 1 January of the year following the one for which your contributions are due. 
The contribution supplement that may possibly be due at the start or the restart of your activity lapses only on 1 January of the 8th year that follows your starter year or the year during which you started your activities anew.


Interruption of limitation period
The term starts anew:

  • when in the meantime you have been summoned before the Labour Court
  • when you receive a court decision with a judgment for payment.
  • in case of attachment
  • when you acknowledge your debt (e.g. you ask for payment in instalments, you are already paying a portion)
  • when you receive a registered letter wherein your fund claims payment of the contributions owing
  • when you are not yet affiliated and the NISSE gives notice to you to get your affairs in order


You paid contributions that were not owed
You must enter a timely claim for repayment of these contributions.
Period of limitation:

  • definitive contributions: 5 years
  • temporary contributions: 8 years
