Member of an executive committee
A Board of Directors of a public limited company can delegate important competences to the executive committee.

Both physical and legal persons can be members of the executive committee.

When a legal person is a member of the executive committee, it must from amongst its directors, business managers, (active) partners, or employees designate a permanent representative.

Supervisory Board members that are directors
These fall under the application of the social act of self-employed persons on the ground of articles 3, §1, 4th point Royal Decree no. 38 and 2 ARS.

Supervisory Board members that are not members of the board of directors
A director is not a company mandated officer. He is thus not obligated to be insured conform to article 3, §1, 4th point Royal Decree KB no 38.
Attention! A director empowered with management and representation competences that correspond to the notion of mandate in the civil sense of the word does fall under the application of 2 ARS.
